What Jim said. First, you cannot sign away your rights - Overtime being one of them. Now, you could have an agreement (written, of course) that states you will make $X and that salary is based on X number of hours per year knowing that the actual hours may fluctuate from the estimate one way or the other slightly. However, in the shop I am sure they all punch a clock and OT is strictly regulated. Worker's comp is another issue. In the shop there are most likely different WC rates for positions. Welders, composite workers, CNC operators and office staff can all have different rates. In the field (crew members) would most likely fall under one rate. When I hire a salaried person I document that their compensation is based on so much for 40 hours and so much for overtime per week as they are usually required to put in more than 40. That way going in, everyone is on the same page. OSHA is another animal. In the shop I am sure the DSR and Force type teams are compliant to the letter. At the track?? How could OSHA even have regs for that?? Could be why they ignore that industry, I don't know. They go after the "easy" industries and nickle and dime them to death.
