Did NHRA "backpedal" or drop the suit after it got what it wanted?
If IHRA stopped using the name, then it was IHRA that backpedaled.
Backpedaling could mean they would be giving up trademark protection. There had to be another reason.
Does not make sense for two reasons.
1) If you have a filed trademark and do not take action to protect it, you can lose trademark protection.
2) If IHRA filed for trademarks, NHRA could fight the application by showing examples that the phrase had been in common use before IHRA started using it. Filing does not give automatic protection.
George Harrison lost a suit \for copying The Chiffons' song "He's So Fine" when he wrote "My Sweet Lord."
Taj Mahal was born in Harlem.
