I'm still miffed about the picture issue though.

Brent..hypothetically speaking.

We're talking about the 70's and all the cool hotrods, etc. You're cruising around and you find images of said hotrods @ NHRA.com..which is copyrighted material shot by Auto Imagery photographers.

By your explanation..it is legal to right-click and save that image..and post it here?

Before the internet it wasn't legal..you couldn't scan/copy a pic and put it in your magazine..or newspaper, etc..without getting permission. I can't see how it's legal now..same with intellectual property that's copyrighted. If it is legal..we've gone a step backwards..IMO. I can see copy/pasting and giving credit on a particular article..for discussion purposes..but pics are a different deal.

...enough of the lawyer stuff... check out my soon-to-be interview at:

Just my opinion, LOL, but I think at least 51% of the page's surface area should be non-commercial! :D I'd rather see it by far be the biggest thing, with buttons off to the side if people choose to wander around.

Hey, at least you've got a thread here to run test passes on! :D See if you can get that thing to pass tech! :D

Yes, it's perfectly legal to post it here because you're not using it for commercial purposes or trying to sell it make money. It falls under "fair use" under copryright and the DMCA. you're not selling it, you're not claiming it's yours and you're not using it for commercial purposes. It's posted for "discussion or comment." The porn companies tried to sue Google because their pictures were showing up in the search results. Guess who won? It wasn't the porn companies.

That's the difference; if you put in in your magazine it would be considered commercial use which would not fall under "fair use."

I'm reminded of Justin Grant finding out that recent pics of his "Don Schumacher's Stardust" (all used with permission) nostalgia funny car were being sold on e-bay as original stuff.

That's when you go after the guy that's passing them off as his own with a cease-and-desist and tell them you want X amount for rights to use the pic. If they ignore you then you take them to court. When it comes time to argue this in court it's always helpful to have the original files to prove you're the owner of the photo. If the guy only has a 1600 x 1200 pixel jpeg file he claims is the original and you show up in court with the 3000 x 2000 raw or jpeg file it's going to make his argument pretty weak. It's also a good idea to put a watermark somewhere on the photo to help prevent photo theft. That way the person can't say they took the pic when it has "photo by Ron Dunlap" watermarked on it. That doesn't mean they can't crop it out but it's a deterrent. Plus it also carries more weight if it ever went to court because you could then prove that not only did they steal the pic, they went so far as to crop out the watermark to try to get away with it.

OK Ron, What would you suggest I add or take away to make 1800-Entertainment less commercial?

From my vantage point, you have 3 commercial areas and 3 news areas, so that is 50/50, but you also have a links section, an awards section, and a calendar. Granted, the award is for your commercial work, but the other 2 are not.

Total = 65 % news/links and 35% commercial... give or take.

See for yourself: 1800-Entertainment

That link again is: 1800-Entertainment ... :D

Ok maybe the mods can explain to me why this post is still up then if they dont allow self promotion...

I mean Hell Erics post was deleted and he only mentioned he had dvd's for sale(at a different site) but this other guy can actaully give a price and description(right here on the Mater) and his post is left untouched...

Either the mods dont go to the nostalgia section or you have to be in a certain "Mater" Click.. Either way its just not right ....

Looks like it's gone now. Unlike that 1-800 Entertainment thing above. :D You should have mentioned it for them for the sake of comparison. :D

Hey, I'm a capitalist to a capitalist! I believe impressing with creativity can sometimes smooth things over. Reminds me of a guy walking up to my truck door in Arizona years ago. He says "I'm not gonna lie to you. I want a drink. I gave him five bucks!" A few weeks ago another guy in Jersey City gave me his story about being another owner-operator "a couple blocks over" with a blown steer tire. I let him finish his story, then asked him if he had any idea how many times I've heard that one in twenty one years of driving? :)
