You might think differently if you were the father or spouse of one of those killed, or if you were injured and had $100,000 in medical bills. Someone is at fault and should own up to it instead of trying to hide behind the "law."

Sounds like the one hiding behind the "law" is the city. After all, they are the ones ultimately responsible. This whole deal should have never been allowed to take place. I have all the compassion in the world for those injured or killed in this tragedy--my wife lost a son in an accident a few years ago, so I have some idea of what they are going through. It has been 5 years, and trust me, you never get over it. The other side of the coin is that no amount of money will ever bring anyone back or totally heal the scars, and as slow as the courts work, the medical bills will drive them into bankruptcy before any settlement is reached. My problem with this lawyers quote was that it seemed they are just hunting for anyone they can wring a buck out of. The city claims they are limited by state law, and I am also sure they carry some type of liability policy that covers them. $600,000 would not even be a drop in the bucket on this deal. This whole legal entanglement will take years and cost tons of money, most of which the true victims will never see.

So you go after GoodYear because they build the tires, Weld because they built the wheels, the chassis builder? Anyone with a contengency decal on the car? thats ludicrous.

The City might be at fault in the shadows but the person' action who caused this will be held responsible.

Maybe the saying is wrong. Maybe intentions should be a factor.

No problem Roger--I am sure you probably agree that tort reform is desparately needed in this country. My business law professor (who was an attorney) in college told us many times that you look for the deep pockets. I know compensation is desparately needed by many. One reason medical expenses are so awfully high is because of ridiculous liability insurance to shield from medical lawsuits. I do have a real problem with the fact that the lawyers in this case will probably get about a third of any settlement. Most of this I am sure will come from insurance companies who in turn---GUESS WHAT---raise the premiums. I certainly dont profess to have the answers--it is a bad situation all the way around.
 
All the legal wranglings aside ... it is going to take balls to tow thru the gates somewhere and face the racing public in an open pit. I am sure he understands that everyone is not going to be happy he is there. Good luck Troy.
