What a sad story. Harry is a good guy, very low key, so this is rather surprising. At 1:30 in the morning though, a father may not be thinking too clearly, especially when his daughter is involved. Sounds more like two people in the wrong place at the wrong time. I hope it all works out for him.

I believe in California they first have to kill you and a minimum of two unarmed family members before you are allowed to confront them with a wooden stick.

and then you have to make sure the criminal ends up in your home, Completely. Not half in, half on the porch, half on the porch and half in the yard. Sad but true. I've been told by Texans that it's not like that here. If you're trespassing and told to leave and you don't, flying buckshot is not uncommon.

However, this is a very sad story and all we can do is hope that it ends up the best way possible for all parties involved.

Trying to remember where in Africa that crime is so high and self defense killings are so common that police will often help drag the intruder's body INTO the house.
 
I thought everyone knew by now to never ever make statements to the police without legal consul. Now they have him bracketed(no pun intended)into a story they like. This will surely make it much harder for a defence attorney to work with. Looks like Harry screwed the pooch.
 
I would have to investigate the 2 minute rule .
I have heard of it pulled in the Military and it says you are not responsible for your actions for two minutes after being woke up.
I like to be up awhile before I assume responcibility for peoples lives.
The fog of deep sleep lends itself to questionable decisions where you are awake and standing up but not fully functioning.
Sounds good to me anyway !
 
It's been along time since I have heard anything about Harry and sad to hear bad news. And, yes, Justin, thank God for Texas and the Castle Doctrine. If he had been in Texas, he would not be in jail. Hope things turn out good for Harry. Man, we are thinking about you! :(
 
In our local throw away newspaper they showed told much of a fine upstanding citizen this Wall guy was:

In 2004, a restraining order was filed against Wall after an alleged domestic dispute between him and his sister-in-law, Nichole Johnson, according to Ventura County Superior Court records.

Wall was also convicted of felony possession of a controlled substance in 2002 and 2004 and was given separate sentences of 30 and 45 days in jail.

Ventura County criminal records show that in 2001 Wall was convicted of carrying a loaded firearm in public and resisting or obstructing a peace officer. A charge of carrying a switchblade knife was dismissed in 2006.

Wow, Jim, thanks for the link. This is just so sad and the remark he made about himself being a hillbilly is just classic Harry. I used to think of his pit area as the pig pen - all three brothers we really nice, though. I hope this all turns out for him. Prayers, Harry.

I just hope the guy he killed had a weapon of some sort and tried to use it,if he didn't he should have planted one, otherwise this will be a slam dunk!

Hey, Jim - The Castle Doctrine - google it - ALOT of interesting stories!

AUSTIN – Gov. Rick Perry signed into law Tuesday a bill that gives Texans a stronger legal right to defend themselves with deadly force in their homes, cars and workplaces.

Both chambers of the Legislature overwhelmingly approved the measure earlier this month. The bill, backed by the National Rifle Association, states that a person has no duty to retreat from an intruder before using deadly force.

"The right to defend oneself from an imminent act of harm should not only be clearly defined in Texas law, but it is intuitive to human nature. You ought to be able to protect yourself," Perry said, surrounded by lawmakers who pushed for the law.

This is the first bill-signing this legislative session by the Republican governor. The law takes effect Sept. 1.

"This is reasonable legislation," Perry said.

The building or vehicle must be occupied at the time for the deadly force provision to apply, and the person using force cannot provoke the attacker or be involved in criminal activity at the time.

Some refer to the measure as the "castle doctrine," drawing from the idea that a man's home is his castle and that he should have the right to defend it.

Fifteen other states have passed similar laws. Texas is the first state to pass such a law this year, said Rep. Joe Driver, a Garland Republican who sponsored the measure.

Sen. Jeff Wentworth, a San Antonio Republican who pressed the issue in his chamber, said the law changes previous Texas law that in some cases requires a person to retreat from an intruder.

The new law will also provide civil immunity for a person who lawfully uses deadly force in any of the circumstances spelled out in the bill. Police and prosecutors can still press charges if they feel deadly force was illegally used, legislative sponsors said.

After looking at the Bryan Wall's criminal record, (9 arrests, 5 convictions, one case still open, a bail forfit and two dismissals), the guy wasn't about to win any "Citizen Of The Year" awards. Harry has to be in his late sixties or early seventies, guys his age don't go to a fight at 1:30 AM without a gun and they never use it to impress anyone, they use it to shoot them. Mr. Wall's life was filled with mistakes, this was just his last.
